In these alternative modes of conflict resolution, unlike with traditional trials, a neutral third party, mutually agreed upon by both parties, is appointed to intervene in the resolution of the dispute. Mediation facilitates settlement discussions in order to reach an agreement that is satisfactory for both parties. The signing of a written agreement seals the dispute. In an arbitration procedure, each party makes representations and the arbitrator renders a binding decision.
